Terms and Conditions of computer support / service work
Between CanadaRAM Ltd. or its parent company Quill Services Ltd. (The Consultant) and _________________________ (The Client)
The Consultant will use its best efforts to resolve customers technical problems in a professional, reasonable and timely manner, taking into consideration the circumstances and nature of the technical problems and best practices of the industry. Response times may be delayed due to research and inquiries, as may be necessary. The Consultant does not assure that every request for technical support will be resolved. The Consultant consultations constitute only advice and suggestions. Technical problems may be a result of software or hardware failure, corruption or user error and may not be correctable.
The Consultant reserves the right to refrain from providing any or all services ordered and refund the Client’s payment, wholly or in part, if minimum system requirements are not met or if technical conditions or customer requirements are unusual, extensive, or beyond the scope of this service agreement as reasonably determined by The Consultant.
THE CLIENT’S RESPONSIBILITY
You understand and agree that prior to contacting or allowing the Consultant to perform diagnostic repair or other services on the Client’s computer, it is the Client’s responsibility to back-up the data, software, information or other files stored on the Client’s computer disks and/or drives. You acknowledge and agree that The Consultant shall not be responsible under any circumstance for any loss or corruption of data and/or software.
You agree to pay fees in accordance with The Consultant’s rates and policies.
LIMITATION OF REMEDY
The Consultant will not be held responsible for any problems arising from third party software installed on the Client’s computer by our technicians, you, or other third party.
The Consultant will not be held liable for lost data due to hardware failure, virus, spyware, corruption or any other situation. If any problems with third party software or hardware arise, it is the Client’s responsibly to obtain support from the manufacturer of the product at fault or contract with the Consultant to do so on the Client’s behalf, chargeable at the hourly rate.
Under no circumstances shall The Consultant be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by The Consultant or out of the installation, de-installation, use of, or inability to use the Client’s computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder.
The Consultant shall not be liable for any failure or delay in performance due to any cause beyond its control. If The Consultant’s ability to render services is impaired by the Client’s failure to cooperate or circumstances beyond the control of The Consultant, The Consultant may choose not to provide services.
LIMITATION OF LIABILITY & RELEASE
By signing our form, you will agree to release and hold harmless The Consultant from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by The Consultant. This includes but is not limited to data loss or lack of function in any component or element of the Client’s computer system and/or peripherals as a result of The Consultant’s actions or the actions of its agents, partners, and/or third-party service providers.
All services shall be guaranteed for thirty (30) days, however if the issue resurfaces and is discovered by The Consultant to have been caused by negligence or misuse on behalf or the customer or other third party, The Consultant shall not be held responsible, and the foregoing guaranty will be nullified. You agree that The Consultant’s total liability for damages related to its provision of services is limited to the total amount you pay for such services, and you release The Consultant from liability for any indirect, incidental, special, or consequential damages.
THE CONSULTANT IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR THE CLIENT’S INABILITY TO USE THE CLIENT’S COMPUTER EQUIPMENT OR OTHER PRODUCT.

Make sure to include the make and
model of your machine, your full shippping address, phone
number, correct email address, the number, expiry date and
name on your credit card plus the card billing address and phone
if different from shipping address. Payment accepted by VISA or Mastercard or
Canadian bank Interac Email Transfer. It must
be your credit
card and the card billing address and shipping addresses must
match.
For
your
protection,
we may
ask for additional proof of ID to be faxed. Third party
address shipments require faxed confirmation. Contact us for PayPal payment options,
can be shipped to verified address only.
Gov't, Education
and Corporate PO's accepted on prior approval of
credit only. Download

Shipping is via Xpress Post, Expedited Parcel, FedEx or Purolator at
our choice. No PO Boxes for Purolator or FedEx. Please ensure
that there is someone at the address during business hours
to sign for the package. We do not guarantee delivery time. Shipping
time and cost may be higher in NT, NU, YT or remote
areas as defined by the courier. An invoice copy will be sent by email.
Shipping is at buyer's risk, Shipping insurance is
1.5% extra on the goods value or by quote - if declined, the buyer assumes all risk of loss or damage. Signature is required for insured parcels.
Installation: Goods are sold under the assumption that you have experience
installing. Installation instructions
for your specific machine are not included. Refer to your owner's manual
or manufacturer's Web site. If you are not confident, please take your machine to a technician for installation. We are not responsible for any damage occuring during or after installation of purchased products, nor for any incidental or consequential damage or data loss arising from installation or use of purchased products.
Outside of Canada or the USA? We generally sell
to North American addresses only. Please Email for shipping costs.
Due to excessive fraud, we do not respond to any commuications
from: Indonesia, Malaysia, Uzbekistan, Belarus, Nigeria and
certain other countries.
Warranty: We only sell new,
fully warranteed premium quality goods. We do not
take trade-ins of used memory. Full manufacturers' warranty
terms apply. Customer is responsible for warranty replacement shipping. Returns by prior approval only, shipping
is not refundable, restocking
charge may apply on non-defective returns. Warranty
replacement only, no return for refund on: Kingston memory, special
